Terms of Service and Privacy Policy

PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING WASLY. THEY ARE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND HYPERION & CO. THAT GOVERNS YOUR USE OF THE WASLY WEBSITE AT WWW.WASLY.CO, THE WASLY APP AT APP.WASLY.CO, AND ALL RELATED FEATURES AND SERVICES (TOGETHER, THE "SERVICE"). BY CREATING AN ACCOUNT, BUYING A PLAN, OR USING THE SERVICE IN ANY WAY, YOU AGREE TO THESE TERMS AND TO THE PRIVACY POLICY BELOW.
Wasly is a product of Hyperion & Co. "Hyperion & Co.", "Wasly", "we", "us", and "our" refer to the operator of Wasly. "You" means the person using the Service. "Household" means the shared Wasly space that you and the people you invite use together.
Terms of Service
Who we are
Wasly is a product of Hyperion & Co., which owns and operates the Service. Payments for Wasly are processed by Paddle, our reseller (see "Payments through Paddle" below), so your card statement may name Paddle, Wasly, or Hyperion & Co. They all refer to the same purchase. You can reach us at any time at support@wasly.co.
Acceptance of these Terms
The Service is offered on the condition that you accept these Terms without modification, together with any operating rules or policies we publish for the Service. Some features may come with additional terms, which we will show you before you use them; those terms become part of these Terms.
We may refuse to offer the Service to anyone and may change who is eligible at any time, to the extent the law allows.
Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or buy a plan. An adult household member may add a dependent member to their household. That adult is responsible for the dependent's use of the Service and for obtaining any consent the law requires.
Each person must have their own account. Keep your password confidential and tell us promptly at support@wasly.co if you think someone else has accessed your account. You are responsible for activity under your account.
Household administrators control who belongs to the household and what role each member has. Members can see household information according to their role. Only invite people you are comfortable sharing that information with.
What Wasly is, and what it is not
Wasly is an organizational tool for households. It helps you record and review expenses, income, budgets, savings goals, accounts, investments, home maintenance, and documents, and it sends reminders and summaries based on what you record.
Wasly is not a bank, broker, payment service, money transmitter, investment adviser, tax adviser, accountant, or lawyer. Wasly does not hold, move, or invest money, does not connect to your bank accounts, and does not execute trades or payments on your behalf.
Nothing in the Service, including answers from Ask Wasly, goal projections, budgets, exchange rates, or investment values, is financial, investment, tax, legal, or other professional advice. Figures shown in the Service are only as accurate as the information you enter and the third-party data we use. Exchange rates and market prices are provided for reference, may be delayed or incomplete, and must not be relied on for trading or other financial decisions. Consult a qualified professional before making financial decisions.
Ask Wasly and other AI features
Ask Wasly and some suggestions in the Service are generated by artificial intelligence. AI output can be incomplete or wrong, even when it sounds confident. Check important answers against your own records before relying on them.
When Ask Wasly or another AI feature proposes adding or changing a record, nothing is saved until you confirm it. You are responsible for reviewing a proposal before you confirm it.
Rules and conduct
You agree to use the Service only for lawful, personal, and household purposes. You may only enter information about other people when you have the right to do so, for example because they are members of your household or have agreed to it. You agree not to, and not to help anyone else to:
- violate any applicable law or regulation, or these Terms;
- use the Service for money laundering, fraud, tax evasion, or to record or hide the proceeds of crime;
- upload anything that infringes another person's intellectual property, privacy, or other rights;
- upload malware or anything designed to disrupt, damage, or gain unauthorized access to the Service or its users;
- probe, scan, or test the Service's security, or bypass any access control or usage limit;
- scrape, crawl, or extract data from the Service by automated means, except through features we provide for that purpose;
- reverse engineer, decompile, or attempt to discover the source code of the Service, except where the law expressly permits it;
- place an unreasonable load on the Service or its infrastructure;
- impersonate any person or misrepresent your affiliation with any person or organization;
- copy, resell, sublicense, or commercially exploit the Service without our written permission; or
- harass, threaten, or abuse anyone, including other household members or our support staff.
We may investigate suspected violations and may suspend or end access to the Service for anyone who violates these Terms.
Your content
Your records, documents, messages to Ask Wasly, and other information you put into the Service ("Your Content") remain yours. You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as needed to provide, secure, and support the Service for you and your household, and to comply with the law. This license ends when Your Content is deleted from the Service, except for copies we must keep by law or that remain for a limited time in backups.
We do not sell Your Content, use it for advertising, or use it to train artificial intelligence models. You are responsible for Your Content and for keeping your own copies of important documents.
If you send us ideas or feedback about the Service, we may use them without any obligation to you.
Our intellectual property
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal and household use during your subscription. The Service, including its software, design, text, graphics, logos, and the Wasly name and marks, is owned by us or our licensors and is protected by intellectual property laws. We reserve all rights not expressly granted to you.
Plans, payments, and renewals
Wasly is offered as paid subscription plans, billed monthly or yearly. Current plans and prices are shown on our www.wasly.co pricing section and at checkout. Prices exclude taxes; any sales tax, VAT, or similar tax is calculated and added at checkout.
Your subscription renews automatically at the end of each billing period for the same period, at the then-current price, and the payment method on file is charged unless you cancel before the renewal date. If we change the price of your plan, we will tell you before the change takes effect, and the new price applies only from your next renewal. You can cancel before then if you do not accept it.
If a renewal payment fails, we or Paddle may retry it and may suspend paid features until payment succeeds.
Payments through Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a Wasly plan, you buy it from Paddle, and your purchase is also governed by Paddle's Buyer Terms.
Paddle collects your payment details, charges your payment method, calculates and remits taxes, and issues receipts and invoices. Charges appear on your card or bank statement as WASLY, usually together with PADDLE.NET (for example, "PADDLE.NET* WASLY"). You can look up a charge, download an invoice, update your payment method, or cancel your subscription at paddle.net, or by contacting us at support@wasly.co.
If you do not recognize a charge, please contact us before disputing it with your bank. We will find the payment and help you, including with a refund where this policy allows one.
Cancellation
You can cancel your subscription at any time from the link in your Paddle receipt, at paddle.net, or by emailing support@wasly.co. Cancellation stops future renewals. Your plan stays active until the end of the billing period you already paid for, and is not renewed after that.
Refund policy
We want you to be happy with Wasly. If you are not, we offer a 14-day money-back guarantee:
- First payment: if you request a refund within 14 days of your first payment for a plan, monthly or yearly, we will refund it in full. No reason is needed.
- Yearly renewals: if you request a refund within 14 days of a yearly renewal charge, we will refund that renewal in full.
- Monthly renewals: monthly renewal charges are not refunded. You can cancel at any time to stop the next renewal and keep access until the end of the month you paid for.
- Duplicate or mistaken charges: if you were charged twice or charged in error, we will refund the extra charge whenever you tell us.
To request a refund, email support@wasly.co from the address you used at checkout, or use paddle.net. Include the date of the charge or your order number if you have it. Refunds are processed by Paddle to the original payment method, usually within 5 to 10 business days of approval, depending on your bank. A refunded subscription is canceled and its paid features end.
This policy does not limit any refund or withdrawal rights you have under the consumer protection law that applies to you. Where that law gives you more, you get more. We may also refund outside this policy at our discretion, for example after an extended outage, and Paddle may refund or decline a refund in line with its own terms, such as in cases of fraud or abuse.
Availability and changes to the Service
We work to keep the Service available and your information safe, but we do not promise that the Service will be uninterrupted, error-free, or available at any particular time. We may change, add, or remove features, set usage limits, or suspend the Service for maintenance or security. If we discontinue the Service entirely, we will give you reasonable advance notice, a way to get a copy of your data, and a pro-rated refund of any prepaid time you have not used.
Termination
You can stop using the Service and ask us to close your account at any time by emailing support@wasly.co. We may suspend or end your access if you materially or repeatedly violate these Terms, if required by law, or if your use creates a security or legal risk for us or other users. Where reasonable, we will tell you first and give you a chance to fix the problem and to get a copy of your data.
When your account is closed, your right to use the Service ends, and we delete your information as described in the Privacy Policy. Any section of these Terms that by its nature should continue after termination continues, including the sections on your content, disclaimers, limitation of liability, indemnification, and disputes.
Disclaimer
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION, CALCULATION, PROJECTION, OR AI-GENERATED ANSWER IN IT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HYPERION & CO. AND ITS OWNER, CONTRACTORS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR FINANCIAL OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR YOUR RELIANCE ON IT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, SUCH AS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, OR YOUR RIGHTS AS A CONSUMER THAT CANNOT BE WAIVED. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hyperion & Co. and its owner, contractors, and suppliers from claims, losses, and expenses, including reasonable legal fees, arising from your misuse of the Service, Your Content, or your violation of these Terms, the law, or another person's rights.
Links and third-party services
The Service may link to or rely on third-party websites and services, such as Paddle for payments. Their own terms and privacy policies govern your use of them, and we are not responsible for their content or practices.
Disputes and governing law
Most problems can be solved quickly by talking to us. Before starting any formal claim, and before disputing a charge with your bank, please email support@wasly.co with a description of the issue. We will try in good faith to resolve it within 30 days.
If we cannot resolve it, these Terms and any dispute relating to the Service are governed by the laws of the place where Hyperion & Co. is established, without regard to conflict-of-law rules, and the courts of that place have jurisdiction. If you are a consumer, this does not take away the protection of mandatory consumer laws where you live, or your right to bring a claim in the courts where you live. You may also bring an individual claim in a small claims court that has jurisdiction.
To the extent permitted by law, any claim relating to the Service must be brought within one year after it arose.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page with a new date at the top. If a change materially affects you, we will notify you in the Service or by email at least 14 days before it takes effect, unless the change is required sooner by law. Changes never apply retroactively. If you continue to use the Service after a change takes effect, you accept the updated Terms; if you do not agree, you can cancel before it takes effect.
General
These Terms, the Privacy Policy, and any additional terms we show you are the entire agreement between you and Hyperion & Co. about the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of the Wasly business, and we will tell you if that happens. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to you may be sent by email or shown in the Service. These Terms are available in English and Spanish; if the versions differ, the English version controls to the extent the law allows.
Privacy Policy
Overview
This Privacy Policy explains how Hyperion & Co., the operator of Wasly, collects, uses, shares, and protects personal information when you use the Service at www.wasly.co and app.wasly.co. Hyperion & Co. is responsible for (the "controller" of) the personal information described here, except payment information that Paddle handles as Merchant of Record, which is covered by Paddle's Privacy Policy.
In short: we collect what is needed to run Wasly for your household, we keep it private to your household, we do not sell it, we do not use it for advertising, and we do not use it to train AI models.
Information we collect
Information you give us:
- Account information: your name, email address, password (stored only as a secure hash), preferred language, default currency, and role in your household.
- Household records: the expenses, income, deductions, budgets, savings goals, accounts, balances, investments, assets, maintenance items, life events, and notes you or your household members enter.
- Documents: files you upload, such as insurance policies, warranties, and contracts, and their details, such as expiry dates.
- Ask Wasly: your messages, Ask Wasly's replies, the changes it proposes, and the household instructions you give it in Settings.
- Support: what you tell us when you email us.
Information created as you use the Service:
- Activity history: a record of each change made in your household, who made it, and when. Household members can review it according to their role.
- Sessions: a record of your signed-in sessions so you can review and sign out of them. We store only a hash of each session token.
- Technical logs: when you use the Service, our hosting provider processes your IP address, browser type, and request details to deliver pages, keep the Service secure, and diagnose errors.
- Website analytics: aggregated page-view statistics through Cloudflare Web Analytics, which does not use cookies or track you across sites.
Information from Paddle: when you buy a plan, Paddle shares with us your name, email address, country, the plan you bought, and the status of your subscription and payments. We do not receive or store your full card number or bank details.
Please do not enter full card numbers, bank passwords, government identification numbers, or other sensitive credentials into Wasly records or Ask Wasly. Wasly does not need them.
How we use information
- To provide the Service: store and show your household's records, calculate totals, budgets, goal pace, and net worth, convert currencies, and value investments.
- To send reminders and summaries you rely on, such as upcoming renewals, maintenance, and the monthly digest.
- To answer Ask Wasly questions and prepare the proposals you confirm.
- To process subscriptions, refunds, and billing questions together with Paddle.
- To respond to support requests.
- To keep the Service secure, prevent fraud and abuse, and fix problems.
- To send service messages, such as account, billing, security, and policy notices. We will only send marketing emails if you have agreed to receive them, and every marketing email will include an unsubscribe link.
- To comply with legal obligations and enforce our Terms.
We do not sell or rent your personal information, share it for cross-context behavioral advertising, or use your household records or Ask Wasly conversations to train AI models. We do not make decisions about you that have legal or similarly significant effects based solely on automated processing.
We do not look at your household records or documents except when you ask us to for support, when needed to investigate a security incident or abuse, or when required by law.
Legal bases
Where the law requires a legal basis for processing, we rely on: performing our contract with you (to provide the Service and process payments); our legitimate interests (to keep the Service secure, prevent abuse, and improve reliability, balanced against your rights); your consent (for example, for optional marketing emails, which you can withdraw at any time); and legal obligations (for example, tax and accounting records).
Service providers we share information with
We share personal information only with service providers that help us run Wasly, only for that purpose, and under agreements that require them to protect it:
- Cloudflare: hosts the website, app, and API, stores your household's database and uploaded documents, runs scheduled reminders, and provides cookieless website analytics.
- Anthropic: provides the AI model behind Ask Wasly and record suggestions. When you use these features, your message and the household records needed to answer it are sent to Anthropic for processing. Under its commercial terms, Anthropic may not use this content to train its models.
- Paddle: our reseller and Merchant of Record. Paddle processes your payment details, taxes, invoices, and refunds as an independent controller under Paddle's Privacy Policy.
- jsDelivr: delivers the icon stylesheet the app uses, so it receives your IP address and browser details when the app loads.
To show exchange rates and investment prices, the Service requests public reference data from market data providers, such as exchange rates and the closing price of a ticker symbol. These requests do not include your personal information or your holdings.
We may also disclose information when required by law or valid legal process, to protect the rights, property, or safety of our users, the public, or us, or as part of a transfer of the Wasly business, in which case this Privacy Policy will continue to apply to your information. Information you choose to share with your household is visible to its members according to their roles.
Cookies and local storage
The Wasly website and app do not set cookies. The app stores two items in your browser's local storage: your sign-in token, which keeps you signed in, and your appearance setting. Both are strictly necessary for the app to work. Paddle's checkout window may set its own cookies to process your payment securely; see Paddle's policies for details. Because we use no advertising or tracking cookies, we do not show a cookie banner.
Retention
We keep your household's information while your account is active, so that your records, history, and documents stay available to you. Ask Wasly conversations are kept until your account is closed, including conversations you have archived.
When you ask us to close your account, we delete your account and your household's records and documents within 30 days. If you are the last member of your household, that includes the household; otherwise the household and its shared records remain with the other members. Database backups are kept for up to 30 days and then overwritten. We keep billing records, and Paddle keeps transaction records, for as long as tax and accounting laws require. Technical logs are kept only for short periods.
Security
We protect your information with encryption in transit (HTTPS), hashed passwords and session tokens, private document storage that is never publicly addressable, strict separation between households at the data layer, role-based access within each household, and an activity history of every change. No method of storage or transmission is completely secure, but we work to protect your information and will notify you and the relevant authorities of a personal data breach as required by law.
International transfers
Our service providers process information in data centers in several countries, which may be outside the country where you live. Where the law requires it, we rely on appropriate safeguards for these transfers, such as standard contractual clauses offered by our providers.
Your rights and choices
Wherever you live, you can ask us to:
- tell you what personal information we hold about you and how we use and share it;
- give you a copy of your personal information in a portable format;
- correct information that is inaccurate (you can also edit most information yourself in the app);
- delete your personal information or close your account;
- restrict or object to certain processing; and
- withdraw any consent you have given, without affecting processing that took place before.
To make a request, email support@wasly.co from the address on your account. We will verify your identity before acting on a request, and respond within 30 days. You may use an authorized agent; we will ask for proof that you authorized them. We will not treat you differently for exercising your rights. If you are not satisfied with our answer, you can complain to the data protection authority where you live, though we would appreciate the chance to address your concern first.
Children
Wasly accounts are for adults. We do not knowingly collect personal information directly from children under 13, or a higher age where the law requires it. A parent or guardian who adds a dependent member to their household is responsible for that member's information and for any consent the law requires. If you believe a child has given us personal information without that consent, contact us and we will delete it.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated version here with a new date, and if a change materially affects how we use your information, we will notify you in the Service or by email before it takes effect.
